DEFINITIONS<\/h2>\n

\u201cBusiness Day<\/strong>\u201d shall mean Monday through Friday between the hours of 8:00 am \u2013 5:00 pm, unless such day is a Federally recognized holiday.<\/p>\n

\u201cCustomer<\/strong>\u201d shall mean any person, organization or entity that enters into a Rental Agreement for laser tag Equipment with LTS or LEGO Brick Party with BPS.<\/p>\n

\u201cEquipment<\/strong>\u201d shall mean any and all laser tag equipment or Brick Party equipment, including but not limited to, taggers, laser tag guns, bunkers, attachments, laptops, LEGO bricks and any other supplies or accessories rented to Customers.<\/p>\n

\u201cEvent Date<\/strong>\u201d shall mean the date on which the Customers event is scheduled to occur, as determined at the time of Rental.<\/p>\n

\u201cGuests<\/strong>\u201d shall mean any person, friend, family, invitee, agent or user the Customer allows access to, or use of, the Equipment.<\/p>\n

\u201cLaser Tag Source<\/strong>\u201d shall mean the Company responsible for providing Rental Equipment and customer service tech support to the Customer for laser tag Equipment. (\u201cLTS\u201d)<\/p>\n

\u201cBrick Party Source\u201d <\/strong>shall mean the Company responsible for providing Rental Equipment and customer service tech support to the Customer for Brick Party Equipment. (\u201cBPS\u201d)<\/p>\n

\u201cMalfunctioning Equipment<\/strong>\u201d shall mean Equipment that does not operate for the Customer as it is intended to operate and which upon return to LTS or BPS, is confirmed to be malfunctioning by LTS or BPS, at its sole discretion.<\/p>\n

\u201cRain-check<\/strong>\u201d shall mean that LTS or BPS authorizes a replacement Rental, at its sole discretion, to a Customer for a Rental, up to the amount of the original Rental.<\/p>\n

\u201cRefund<\/strong>\u201d shall mean that LTS or BPS refunds the full Rental amount back to the Customer.<\/p>\n

\u201cRental<\/strong>\u201d shall mean the confirmed order for the rental of Equipment or Brick Party by the Customer, once payment or confirmed purchase order has been received by LTS or BPS.<\/p>\n

\u201cReservation<\/strong>\u201d shall mean the placing of a Customer order for Rental of Equipment with LTS or Brick Party with BPS, prior to payment for, or receipt of, a confirmed purchase order, by LTS.<\/p>\n

\u201cReturn Date<\/strong>\u201d shall mean the date on which Equipment is due to be received by LTS or BPS after Customer Rental, as determined at the time of Rental.<\/p>\n

\u201cShip Date<\/strong>\u201d shall mean the date on which rental Equipment must ship by in order to arrive on schedule, in accordance with the shipping schedule lead times outlined below, as determined at the time of Rental.<\/p>\n

RELEASE OF LIABILITY<\/h2>\n

By entering into a Rental agreement with Laser Tag Source (LTS) or Brick Party Source (BPS), Customer agrees to these terms and conditions for Rental. The Customer assumes all responsibility for any and all users of the Equipment and assumes responsibility for any and all inherent risks incident to and arising from the Equipment or its use, whether occurring prior to, during or subsequent to the Event Date. Customer also agrees that LTS or BPS, its employees, agents, officers and directors are hereby released from any responsibility for death, personal injury, property damage, or any other claims in any way arising from the Equipment or its use.<\/p>\n

PAYMENT POLICY<\/h2>\n

Customer must provide payment or a copy of a confirming purchase order to LTS or BPS at least five (5) Business Days prior to the Ship Date, to ensure on time delivery. Any payment or copy of confirming purchase order received inside of the five (5) Business Day pre-shipment window, is subject to additional shipping charges for expedited shipment.<\/p>\n

CANCELLATION POLICY<\/h2>\n

All cancellations or additions to Rentals must be received at least five (5) Business Days in advance of the Ship Date, otherwise payment and shipment, shall continue as per original reservation. Cancellations, after payment has been received, but prior to shipping of the Rental shall result in the withholding of a processing fee of twenty-five (25%) percent of the amount of the Rental. No refunds shall be issued for cancellations received after Equipment has shipped.<\/p>\n

Once Rentals are confirmed, LTS or BPS is not responsible for Event Date changes, changes due to inclement weather or cancellations.<\/p>\n

CUSTOMER RESPONSIBILITIES<\/h2>\n

Customer shall inspect all pieces of Equipment for proper functioning and usage instructions, at least two (2) hours prior to their event in case LTS or BPSA Tech Support is necessary. Tech Support can be reached by calling or texting (1-434-515-2888) to address any and all questions pertaining to Equipment, usage or technical issues. Failure by Customer to contact Tech Support to report Malfunctioning Equipment, shall result in Customer not receiving a refund for Malfunctioning Equipment.<\/p>\n

If Equipment arrives damaged, Customer agrees to contact LTS or BPS, via phone at (1-434-515-2888), to notify LTS or BPS of any such damages that occurred during shipment. Any such failure to notify LTS or BPS, results in the Customer accepting full responsibility for the Equipment.<\/p>\n

Customer is responsible for any and all damage to Equipment, at the below listed rates, for each individual item damaged. LTS or BPS shall determine, at its sole discretion, whether Equipment is damaged, upon return.<\/p>\n

• * $45.00 for every damaged Phoenix LTX laser tag gun<\/li>\n

• * $450.00 for every damaged laptop<\/li>\n
• * $125.00 for every damaged bunker<\/li>\n
• * $719.00 for every damaged iCombat Barracuda<\/li>\n
• * <\/strong>$2 per ounce of missing LEGO bricks<\/li>\n<\/ul>\n

  MALFUNCTIONING EQUIPMENT<\/h2>\n

  In the event Equipment does not function properly, Customer shall contact Tech Support by calling or texting (1-434-515-2888). If Tech Support is unable to rectify any Malfunctioning Equipment issues, LTS or BPS will Refund the Rental amount for each piece of Malfunctioning Equipment, deemed to be Malfunctioning Equipment. LTS or BPS is not responsible for Customer or its Guest(s), user errors.<\/p>\n

  DELAYED EQUIPMENT ARRIVAL<\/h2>\n

  Should Equipment not arrive prior to the event, there is a 100% money back guarantee Refund, unless the unavailability of Equipment is specifically due to an event beyond LTS\u2019s or BPS\u2019s reasonable control and without its fault or negligence. (\u201cForce Majeure\u201d) Examples of Force Majeure events include, but are not limited to: acts of God; unusually severe weather; war; embargo; natural disaster; sabotage; explosion; riot; fire; strike or labor dispute; actions or failures to act on the part of governmental authorities which delay or prevent performance; or LTS\u2019s or BPS\u2019s inability, despite due diligence to obtain required licenses. In the case of Force Majeure events, LTS or BPS shall issue a \u201cRain-check\u201d for the total value of the Rental, to be used within one (1) year of the original event date. Rain-check order reservations must be made in accordance with the usual order procedures and shipment timing, as outlined in this Agreement and are subject to Equipment availability.<\/p>\n

  EQUIPMENT RETURNS<\/h2>\n

  Customer is responsible for return shipment of the Equipment to LTS or BPS. Customer agrees to deliver the Equipment to an authorized UPS drop-off facility within one Business Day of the Event Date. Any Equipment postmarked after this date shall be considered \u201cre-rented\u201d and shall be charged a full Rental fee of between $9.99.00 to $70.00, per tagger or $99.99 per 25 pounds of LEGO bricks.<\/p>\n

  Equipment returns include packing foam used with the iCombat, Battle Rifles, and the Lux. Missing packing foam will result in a $25 fee per missing piece of foam. Missing foam molds will result in a $75 fee per missing piece of foam.<\/span><\/p>\n

  Customer may return Equipment in the original box it was shipped to Customer in, or repackage the return shipment in alternative packaging, at the Customers own risk. All return shipping damages resulting from; i) improper boxing or taping of the outside shipping package, ii) inadequate wrapping or bubble wrapping of the individual pieces of Equipment, and iii) return shipping Equipment loosely within the shipping package, are the sole responsibility of the Customer.<\/p>\n

  • <\/strong>* LTS or BPS offers a 100% refund for any Rental Equipment deemed to be Malfunctioning Equipment, as per the terms of this Agreement.<\/li>\n
  • <\/strong>* LTS or BPS offers a 100% refund for any Rental Equipment that does not arrive prior to the Customer\u2019s event, as per the terms of this Agreement.<\/li>\n<\/ul>\n
